These Terms & Conditions govern your use of Zikit ("the Service"), operated by Zikit ("we", "us", "our").
1. Service Description
Zikit is a website change monitoring service that checks web pages on a schedule and provides AI-powered summaries of detected changes.
2. Eligibility & Age
You must be at least 13 years old to use the Service. If you are a resident of the European Economic Area or the United Kingdom, you must be at least 16 years old. The Service is not directed at, and we do not knowingly collect data from, children under these ages. If you believe a child has provided us personal data, contact support@zikit.ai and we will delete it.
3. Payment & Billing
Payments are processed by our merchant of record, Paddle.com Market Limited, who also acts as the reseller of the Service. Paddle handles all billing, invoicing, sales tax, and payment processing on our behalf. By purchasing a subscription, you agree to Paddle's Terms of Service.
4. Free Plan
We offer a free plan with limited features (3 sites with unlimited pages each, daily checks, email alerts). No credit card is required. You may upgrade to a paid plan at any time for additional features.
5. Acceptable Use
You agree to only monitor web pages you have a legitimate interest in. You must not use the Service to monitor pages in violation of any applicable laws, the terms of service of the monitored websites, or any intellectual-property rights. You are solely responsible for ensuring that your monitoring activity is lawful in your jurisdiction.
6. Account Termination
We may suspend or terminate your account if you (a) violate these Terms, (b) use the Service to harass, harm, or defraud others, (c) abuse the free plan through multiple accounts, or (d) fail to pay amounts due. You may terminate your account at any time from the dashboard. On termination, your data is deleted per the Privacy Policy retention schedule.

8. Warranty Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. We do not warrant that every change will be detected, that alerts will be timely, or that AI summaries will be accurate.
9. Limitation of Liability
To the fullest extent permitted by law, Zikit's total liability for any claim arising out of or related to the Service is limited to the fees you paid us during the twelve (12) months preceding the claim, or USD 100 if you are on the free plan. In no event shall Zikit be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits or lost business opportunities, even if advised of the possibility of such damages. Some jurisdictions do not allow these exclusions, so they may not apply to you.
10. Indemnification
You agree to indemnify, defend, and hold harmless Zikit and its operators from any claim, liability, damage, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any law or third-party right (including monitoring pages in a way that violates copyright, trade-secret, or contractual obligations), or (d) any content you submit to the Service.
11. Intellectual Property
All content, code, and intellectual property of Zikit remains owned by Zikit. You retain full ownership of your data. We grant you a limited, non-exclusive, non-transferable license to use the service for its intended purpose during your subscription period.
12. Governing Law & Jurisdiction
These Terms are governed by the laws of the State of Israel, without regard to conflict-of-laws principles. The competent courts of Tel Aviv-Jaffa, Israel shall have exclusive jurisdiction over any dispute, except where mandatory local consumer law of your country of residence grants you the right to bring a claim in your home courts.
13. Class Action Waiver
To the extent permitted by applicable law, you and Zikit agree to resolve disputes on an individual basis and waive the right to bring or participate in a class action, collective action, or representative proceeding. This waiver does not apply where prohibited by law (including certain consumer-protection regimes in Israel and the EU).
14. Dispute Resolution
Before initiating legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 days. Either party may initiate this process by sending written notice to the other party describing the dispute and proposed resolution.
15. Force Majeure
Neither party is liable for any failure or delay caused by events beyond its reasonable control, including acts of war, civil unrest, natural disasters, pandemics, government actions, internet outages, or failures of third-party service providers.
16. Modifications
We may update these Terms from time to time. Material changes will be notified by email or a prominent notice in the dashboard at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance.
